Who you are dealing with, and what you are agreeing to

Next Fragrance is a business of Next Collective Pty Ltd (ACN 636 921 429), an independent fragrance house composing scent in an Adelaide studio. In these terms, "we", "us" and "our" mean that company.

By using this website or buying from it, you agree to these terms. If you do not agree with them, please do not use the site or place an order.

These terms sit alongside our privacy policy and our shipping and returns policy, both of which form part of this agreement.

Who can buy

You must be at least 13 to create an account or place an order, and you confirm that you are when you do.

If you are under 16, a parent or guardian must complete the purchase and hold the account, because we do not knowingly collect personal information from anyone under 16. See our privacy policy for what that means in practice.

Orders

An order is an offer to buy. The contract forms when we accept it, which is when we dispatch your order, not when checkout confirms it.

We may decline or cancel an order where:

• a price or stock level was published in error
• we suspect the order is fraudulent
• we suspect bulk buying for resale
• we cannot lawfully ship the product to your address

If we cancel an order you have already paid for, you get a full refund. That is the entire remedy in those circumstances.

Prices and currency

Prices on this site are in Australian dollars and include GST where GST applies.

Prices can change without notice, but never after you have placed an order. If a product is listed at an obviously wrong price, we will contact you before charging you anything.

Orders shipped outside Australia may attract duties and import taxes charged by your own country. Those are not included in the price or the shipping cost. See shipping and returns.

Payment

Payments are processed by Shopify Payments, PayPal and Afterpay. We never see or store your full card details.

Placing an order authorises us to charge the payment method you selected. Where you pay by instalments, the instalment agreement is between you and that provider, not with us.

Delivery

We ship Australia-wide, and we ship perfume oils only to New Zealand, the United States, the United Kingdom and the European Union. Eau de parfum and room sprays cannot leave Australia, because they are alcohol based and classed as a dangerous good for air freight.

Delivery timeframes are estimates given to us by the carrier and are not guaranteed. Full terms, including lost parcels, incorrect addresses and parcels marked as delivered, are in our shipping and returns policy.

Returns and refunds

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.

In short: faulty, damaged or misdescribed products can be refunded, replaced or exchanged within 14 days of delivery. We do not refund change of mind, though we will exchange or refund a sealed, unopened product within 14 days. Opened fragrance cannot be returned, for hygiene reasons. Using our products

Our products are cosmetics. They are for external use on skin, or for the home in the case of room fragrance, and nothing else.

Fragrance sits differently on different people. If you have sensitive skin or a history of reactions, patch test on your inner arm and leave it a day before you wear a fragrance properly. Stop using a product if your skin reacts to it.

Our products are not medicines. They are not intended to diagnose, treat, cure or prevent any condition, and we make no therapeutic claim about them. Except where the law says otherwise, we are not responsible for allergic reactions, skin sensitivity or misuse of a product.

Keep fragrance away from flame and out of reach of children. Store it out of direct sunlight.

Our intellectual property

Product names, branding, logos, photography, formulas, website design, written content and marketing material on this site belong to Next Collective Pty Ltd.

You may not copy, reproduce, distribute, modify or resell any of it without our written permission. Linking to us, quoting us with attribution and sharing our posts are all fine and welcome.

Your account

You are responsible for keeping your login details to yourself and for anything done through your account.

We may suspend or close an account that is being misused, used fraudulently, or used to abuse a promotion, a discount code or the returns process.

Affiliates and creators

Where we run an affiliate or creator programme, we may cancel a discount code, reverse a commission earned on a cancelled or fraudulent order, or end a partnership.

Anyone promoting us must disclose the relationship as Australian law requires, and must not claim things about our products that we do not claim ourselves. Misleading promotion ends the partnership.

Email and SMS

If you opt in, we send marketing by email and SMS. Frequency varies, and your carrier's standard message and data rates apply.

Unsubscribe any time using the link in an email, by replying STOP to an SMS, or by emailing support@nextfragrance.com. Consenting to marketing is never a condition of buying anything.

Our liability

Nothing here excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Subject to that, and to the maximum extent the law permits, our liability for any claim connected to a product or this website is limited to replacing the product or refunding what you paid for it, and we are not liable for indirect or consequential loss, including lost profit, lost revenue or business interruption.

Events outside our control

We are not liable for delay or failure to perform caused by something genuinely beyond our reasonable control, such as natural disaster, epidemic, government action, industrial action, supply chain failure or carrier disruption. Where such an event stops us fulfilling an order, we will tell you and refund you.

Governing law

These terms are governed by the laws of South Australia and the Commonwealth of Australia. Disputes go to the courts of South Australia, and you and we both submit to their jurisdiction.

If you are buying from outside Australia, this does not deprive you of the protection of mandatory consumer laws in your own country.

Changes to these terms

We may update these terms. The version that applies to your order is the version published when you placed it. This page carries the date it was last revised, at the top.
